About Attorney
Jessica T. Arena

Jessica T. Arena is the Principal Attorney and Founder of JT Arena Law, a specialized federal immigration litigation firm focused exclusively on mandamus actions to compel USCIS adjudication of unreasonably delayed applications.

After several years representing immigrants in non-profit settings before USCIS, Ms. Arena founded her practice with a singular focus: federal court litigation to enforce agency action on cases trapped in administrative delay. Her practice centers on EB-5 investor visa cases, I-485 adjustment of status applications, I-730 refugee and asylee relative petitions, I-130 family-based petitions, consular processing delays, asylum applications, and naturalization proceedings.

Ms. Arena has successfully resolved numerous mandamus cases. She personally evaluates every case to determine whether federal litigation is appropriate and strategically advantageous for the client. Her approach emphasizes optimal timing—filing when the documented delay is strongest—rather than filing as early as possible.
Ms. Arena is known for transparent communication with clients about what federal litigation can and cannot accomplish, realistic assessments of likely outcomes, and clear pricing structures. She handles litigation strategy, negotiations with U.S. Attorneys, substantive briefing, and court appearances, maintaining direct oversight of all active matters. Ms. Arena practices in most district courts across the United States and earned her law degree from UC Davis School of Law. She is a dual national of the United States and Mexico and is bilingual in English and Spanish.

Five Key Differentiators:

1. Exclusive Focus on Mandamus Litigation
Federal court immigration delay litigation is all we do. This singular focus means we’ve developed deep knowledge of mandamus standards, venue selection, settlement negotiation, and strategic timing that general immigration firms cannot match.
We’ve successfully resolved hundreds of delayed immigration cases nationwide. Most cases settle within 60-90 days of filing, with the government committing to specific adjudication deadlines. Our experience spans EB-5 investor visas, I-485 adjustments, asylum applications, naturalization matters, and family-based petitions.
We litigate in federal district courts across the country and maintain working relationships with U.S. Attorneys’ offices from California to New York. We understand the procedural nuances and settlement practices in different jurisdictions, allowing us to select optimal venue and timing for your case.
We don’t file too early (risking dismissal) or too late (losing leverage). We analyze TRAC factors, processing time benchmarks, and your specific circumstances to determine when filing will produce the strongest position. Our systematic approach to case evaluation and complaint preparation is refined through years of successful litigation.

You work directly with experienced attorneys, not paralegals or case managers. We provide clear explanations of the process, realistic timeline expectations, and upfront flat-fee pricing. Our bilingual team (English/Spanish) ensures clear communication throughout your case. You’re informed at every stage, from filing through settlement and final resolution.
